Terms of Service
MyohackerSLP, PLLC
These Terms of Service (the “Terms”) are an agreement between you and MyohackerSLP, PLLC (the “Company,” “we,” “us,” or “our”) governing your use of MyohackerSLP.com (the “Site”) and the content, accounts, and services offered on it.
By using the Site, creating an account, or making a purchase, you agree to these Terms. If you do not agree, do not use the Site. When you create an account you are asked to affirmatively accept these Terms and our Privacy Policy; when you purchase or enroll in a course or program, the applicable Terms of Purchase for that course or program also applies and is presented to you at that time.
1. The Short Version
- You must be an adult to have an account; your child participates through your account, with you.
- The content here is educational from a licensed speech-language pathologist acting as an educator; it is not therapy or medical advice, and no provider–patient relationship is created.
- What you buy is for you and your household; please don’t share logins or redistribute the materials.
- Each purchase is governed by the Terms of Purchase shown at checkout or enrollment.
- All sales are final. The full refund terms for anything you buy are in its Terms of Purchase, disclosed before you buy.
- Texas law governs these Terms, disputes are heard in Fort Bend County, Texas, we each give up the right to bring class actions, and what we can be held liable for is limited (Sections 9, 10, and 13).
- We’ll tell you before any material change to these Terms takes effect, by email to the address on your account and/or a prominent notice on the Site.
This summary is for convenience; the sections below are the agreement and control if anything could be read differently.
2. Eligibility and Accounts
You must be at least 18 years old and able to enter into a binding contract to use the Site or create an account. Accounts are held by adults only. A child may take part in course practice activities through their parent or legal guardian’s account, under that adult’s supervision; the account holder is responsible for all activity on the account.
You agree that the registration information you provide is accurate and kept up to date, that you will not impersonate anyone else, and that you will keep your sign-in credentials confidential and not share account access with anyone outside your household. You are responsible for activity that occurs under your account. If you believe your account has been accessed without authorization, tell us promptly at info@myohackerslp.com.
3. Acceptable Use
You may use the Site only for lawful purposes. You agree not to:
- post or transmit anything unlawful, threatening, abusive, defamatory, obscene, or invasive of another person’s privacy or publicity rights;
- interfere with the Site’s operation or security, probe or circumvent access controls, or access content or accounts you are not authorized to access;
- use the Site to violate any law that applies to you;
- scrape, harvest, or bulk-download Site content or user information.
4. Purchases
Courses and programs are purchased or enrolled in under a Terms of Purchase presented at the point of purchase or enrollment (for example, at Stripe checkout, at free enrollment, or on first access to a granted course). That Terms of Purchase (the version you accept) governs that purchase, including its payment, refund, safety, and license terms. If anything in these Terms conflicts with an accepted Terms of Purchase for a specific purchase, the Terms of Purchase controls for that purchase.
Refund posture, stated up front: all sales are final. Any refund the Company elects to issue in a particular case is a one-time, discretionary courtesy and does not waive or modify this policy for that or any other purchase. The full refund terms for each course are in its Terms of Purchase, disclosed before you buy.
5. Educational Content, Not Medical Advice
All Site content is educational. The Company’s founder, Karindy Ong, is a licensed Speech-Language Pathologist, but the content is provided in her capacity as an educator and author, not as your or your child’s treating clinician, and your use of the Site creates no provider–patient relationship of any kind. Never disregard professional medical advice, and never delay seeking it, because of something you encountered on this Site. If you think you or your child may have a medical emergency, call 911 or your local emergency number. The full Disclaimers at /disclaimer are part of these Terms.
The Site also describes clinical services offered through Karindy Ong’s clinical practice (see the Services page). Submitting the contact form or requesting an appointment does not itself create a provider–patient relationship; clinical services, if you engage them, are separate engagements governed by the practice’s own intake, consent, and privacy documents, not by these Terms. If you or your child are patients of the practice, the Site and its courses remain general education and are not part of any treatment plan.
6. Intellectual Property and Your License
The Site and its content (including courses, videos, text, PDFs, graphics, logos, the MyohackerSLP name, and the selection and arrangement of all of it) are owned by the Company or its licensors and protected by copyright, trademark, and other laws.
We grant you a limited, personal, non-exclusive, revocable, non-transferable license to access and view the Site’s content (and, for purchased content, the license granted in the applicable Terms of Purchase) for your personal, non-commercial use within your household. You may print or save one copy of free materials for personal use, keeping all copyright notices intact.
Except as that license allows, you may not copy, republish, sell, distribute, publicly display, create derivative works from, or otherwise exploit Site content. You may not upload Site content to, or make it available through, any software, platform, or database (including any artificial-intelligence tool or dataset) where it could be reproduced, extracted, or used for training. We may suspend or terminate access, without refund, for violation of this section, and may seek any other remedy available at law.
7. Reviews and Feedback
You are free to share honest reviews and opinions about the Company, the Site, and its courses, positive or negative, in any forum, and nothing in these Terms restricts that or transfers ownership of any review to the Company. You agree only that any review or public statement will be truthful and lawful, and will not be defamatory, deceptive, or in violation of another person’s rights. If you send us ideas or suggestions, we may use them without obligation or compensation, but this never extends to your reviews, your likeness, or your personal story, which we will not use in marketing without your separate permission.
8. Third-Party Sites and Services
The Site links to third-party websites, products, and services (including payment processing and video conferencing). We are not responsible for their availability, accuracy, content, or policies, and a link is not an endorsement. Your dealings with any third party, including purchases through affiliate links, are between you and that third party, under its terms.
9. Disclaimer of Warranties
The Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure. Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.
10. Limitation of Liability
To the fullest extent permitted by law, the Company will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages (including lost profits, lost data, or service interruption) arising out of or relating to your use of the Site, even if advised of the possibility of such damages.
To the fullest extent permitted by law, the Company’s total cumulative liability to you for all claims arising out of or relating to the Site or these Terms will not exceed the greater of $100 or the amounts you paid to the Company in the twelve months before the event giving rise to the claim.
The limitations in this section do not apply to liability for gross negligence, willful misconduct, or fraud; do not waive or release any claim belonging to your child; and do not limit any claim or remedy that cannot be waived or limited under applicable law, including under the Texas Deceptive Trade Practices–Consumer Protection Act.
11. Indemnification
You agree to indemnify and hold the Company harmless from third-party claims, damages, and reasonable attorneys’ fees arising out of your breach of these Terms or your violation of law in connection with your use of the Site. The Company will notify you promptly of any such claim and reasonably cooperate with you, at your expense, in its defense.
12. Suspension and Termination
You can stop using the Site, or delete your account, at any time. We may suspend or terminate your account or access if you materially breach these Terms or an applicable Terms of Purchase, or if we are required to by law. If we terminate your access without your breach, we will refund the prorated unused portion of anything you have paid for but not received. Sections that by their nature should survive termination (including licenses’ restrictions, disclaimers, limitations of liability, and dispute terms) do survive.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules.
Talk to us first. Before filing any claim, you and the Company each agree to send the other a written description of the dispute and give the other party thirty (30) days to work toward a good-faith resolution (write to info@myohackerslp.com; we will use the email on your account).
If the dispute is not resolved informally, any claim arising out of or relating to these Terms or the Site shall be brought only in the state or federal courts located in Fort Bend County, Texas, and you and the Company each consent to the jurisdiction of those courts. Either party may instead bring an individual claim in small-claims court in any court of competent jurisdiction.
Individual claims only. To the fullest extent permitted by law, you and the Company each waive the right to participate in a class, collective, or representative action against the other. Each party may bring claims against the other only in an individual capacity. This paragraph does not waive either party’s right to a remedy, only the class form of proceeding.
14. Changes to These Terms
When we update these Terms we will post the revised version here and update the “Updated” date below. If a change is material (for example, a change to the dispute terms, to your license, or to your rights under these Terms), we will provide notice before the change takes effect, by email to the address on your account and/or a prominent notice on the Site, and where required we will ask for your renewed acceptance. Continued use of the Site after the effective date of a revised version constitutes acceptance of that version. A Terms of Purchase you have already accepted for a completed purchase is not changed by an update to these Terms.
15. General
These Terms, together with the Privacy Policy, the Disclaimers, and any Terms of Purchase you accept, are the entire agreement between you and the Company about the Site, and supersede prior agreements on that subject. If any provision is held invalid or unenforceable, it will be limited or severed to the minimum extent necessary and the rest remains in effect. Our not enforcing a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of the business, with notice to you. Section headings are for convenience only.
